3.1 Account Registration

Users must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are solely responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breaches.

3.3 Eligibility

Users must be at least 18 years old or have legal guardian consent. Business accounts must be authorized by the organization to enter into this agreement.

3.4 Team and Workspace Management

Account owners are responsible for managing team member access, workspace permissions, and ensuring all team members comply with these Terms.

4.1 Subscription Plans

Social Genius offers four subscription tiers: Social Starter (Free), Social Pro ($29/month), Social Business ($99/month), and Social Enterprise (custom pricing).

4.2 Payment and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through third-party payment processors.

4.3 Auto-Renewal

Subscriptions automatically renew unless canceled before the next billing cycle. Users can cancel or modify subscriptions through their account dashboard.

4.4 Usage Limits and Overages

Each plan includes specific limits for AI tokens, API calls, posts, and other resources. Exceeding limits may result in service restrictions or additional charges.

4.5 Refunds

Refunds are considered on a case-by-case basis for unused portions of subscriptions. Enterprise customers may have different refund terms as specified in their agreements.

5.1 Prohibited Content

You may not create, generate, or publish content that:

• Violates any laws, regulations, or third-party rights
• Contains hate speech, harassment, or discriminatory content
• Infringes on intellectual property rights
• Includes misleading, deceptive, or fraudulent information
• Contains adult content, violence, or harmful material
• Violates platform-specific terms of service

5.2 AI Content Responsibility

Users are responsible for reviewing and approving all AI-generated content before publication. Social Genius provides tools but users maintain editorial control and legal responsibility.

5.3 Platform Compliance

Users must comply with the terms of service of all connected social media platforms and are responsible for maintaining platform-specific compliance.

6.1 Service Ownership

Social Genius retains all rights, title, and interest in the platform, AI models, algorithms, and underlying technology.

6.2 User Content Rights

Users retain ownership of their original content and data. You grant Social Genius a limited license to process, analyze, and improve our services using your content.

6.3 AI-Generated Content

Users own the rights to AI-generated content created through our platform, subject to these Terms and applicable laws. Users are responsible for ensuring generated content doesn't infringe on third-party rights.

6.4 Feedback and Suggestions

Any feedback, suggestions, or ideas provided to Social Genius may be used freely without compensation or attribution.

7.1 Data Collection and Use

Our Privacy Policy details how we collect, use, and protect your information. By using Social Genius, you consent to our data practices as described in the Privacy Policy.

7.2 AI Training Data

We may use aggregated, anonymized usage data to improve our AI models and services, but will not use your personal content for training without explicit consent.

7.3 Third-Party Integrations

Social media platform integrations are subject to their respective privacy policies and terms. Users control what data is shared with connected platforms.

8.1 Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. Scheduled maintenance and updates may temporarily affect service availability.

8.2 AI Limitations

AI-generated content may not always be accurate, appropriate, or original. Users must review and validate all generated content before use.

8.3 Third-Party Dependencies

Some features depend on third-party services and platforms. We are not responsible for third-party service disruptions or changes to their terms.

9.1 User Termination

Users may terminate their account at any time through the account dashboard or by contacting support. Paid subscriptions will continue until the end of the billing period.

9.2 Service Termination

We may suspend or terminate accounts for violations of these Terms, non-payment, or other legitimate business reasons with appropriate notice.

9.3 Data Retention

Upon termination, user data will be retained for 30 days to allow for data export or account recovery, after which it will be permanently deleted.

10.1 Service Disclaimer

Services are provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

10.2 Limitation of Liability

Social Genius's liability is limited to the amount paid for services in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

AI-generated content is provided as a tool to assist users. We do not guarantee accuracy, originality, or suitability of generated content for any specific purpose.
